About this agreement
This End User Licence Agreement (“EULA”) is a legal agreement between you and Anti Skint Club Ltd (TBC) (company number TBC, registered office TBC) — “we”, “us” or “our”. It covers the Anti Skint Club mobile app and any updates we provide (the “App”).
By downloading, installing or using the App, you agree to this EULA. If you don’t agree, please don’t install the App (or delete it if you already have).
Your use of the club through the App — including Pods, mentoring, the Planner and Power Tools — is also governed by our Terms of Use. If this EULA and the Terms of Use conflict on something about the App itself, this EULA applies.
Your licence to use the App
We give you a personal, non-exclusive, non-transferable, revocable licence to download, install and use the App on any phone or tablet you own or control, for your own personal, non-commercial use, as allowed by the rules of the app store you got it from.
We license the App to you — we don’t sell it. We (and our licensors) keep ownership of the App and all intellectual property rights in it.
You must be 18 or over to use the App.
What you can’t do
Except where the law allows it and this can’t be excluded, you must not:
- copy, change, translate or make your own version of the App
- reverse engineer, decompile or try to extract the App’s source code
- rent, lend, sell, sublicense or otherwise give the App to anyone else
- remove or change any copyright, trade mark or other notices
- use the App in any unlawful way, to harm others, or in a way that breaks our community rules
- try to get around security features, access systems you’re not allowed to, or interfere with how the App or our services work (including through bots, scraping or overloading)
- record, capture or share other members’ Pod sessions, messages or details without permission
App store terms
If you downloaded the App from the Apple App Store
- This EULA is between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- Your licence is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing, where available).
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you can tell Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, as set out in this EULA.
- We, not Apple, are responsible for dealing with any claims by you or a third party relating to the App or your use of it — including product liability claims, claims that the App doesn’t meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo, or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms (such as your mobile network’s terms) when using the App.
- Apple and its subsidiaries are third-party beneficiaries of this EULA. Once you accept it, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
- Questions, complaints or claims about the App should be sent to us using the details below.
Where this EULA doesn’t cover something, Apple’s Licensed Application End User License Agreement (opens in a new tab) applies, to the extent it’s consistent with this EULA.
If you downloaded the App from Google Play
Your use of Google Play is governed by the Google Play Terms of Service (opens in a new tab). This EULA is between you and us, not Google. Google isn’t responsible for the App or its content, and has no obligation to provide support for it.
In-app purchases
If we offer paid features in the App, you’ll buy them through your app store account, and the app store’s payment and refund rules will apply as well as your legal rights. We’ll always show you the price before you buy. Any subscriptions can be managed or cancelled in your app store account settings.
Updates and device requirements
We may release updates to fix bugs, improve security or add features. Some updates may be needed for the App to keep working properly — if you choose not to install them, parts of the App may stop working. We’re not responsible if the App doesn’t work because you haven’t installed an update.
The App needs a compatible device, an up-to-date operating system and an internet connection. Your mobile network may charge you for data. We’ll always make sure the App matches the description we gave you when you downloaded it.
Permissions and your data
The App may ask for permission to use your camera and microphone (for video Pods and mentoring calls) and to send notifications (for reminders and messages). You can change these at any time in your device settings — some features may not work without them.
Our Privacy Policy explains how we collect and use personal data through the App, and our Cookie Policy covers similar technologies.
Third-party services
The App relies on some third-party services (for example, for hosting, video calls, sign-in or payments) and may link to other websites or apps. Those services may have their own terms and privacy policies. We’re not responsible for third-party content or services we don’t control, but we choose our providers carefully.
Ending this licence
You can end this licence at any time by deleting the App. Deleting the App doesn’t delete your account — to do that, see Delete your account.
We may end your licence if you seriously or repeatedly break this EULA or our Terms of Use. Where reasonable, we’ll warn you first. When the licence ends, you must stop using the App and delete it from your devices.
Anything in this EULA that is meant to continue after it ends (such as our responsibility to you) will continue.
Our responsibility to you
Nothing in this EULA affects your legal rights as a consumer, including under the Consumer Rights Act 2015.
We’re responsible for loss or damage you suffer that is a foreseeable result of us breaking this EULA or failing to use reasonable care and skill. If defective digital content we supply damages your device or other digital content belonging to you, and this happened because we didn’t use reasonable care and skill, we’ll repair the damage or compensate you.
The App is for personal use. We’re not responsible for business losses, or for loss or damage that wasn’t foreseeable or that was caused by events outside our reasonable control.
We don’t exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can’t be excluded or limited by law.
Content in the App is general guidance — it isn’t regulated financial, legal or medical advice. See What we can and can’t promise in our Terms of Use.
Changes to this EULA
We may update this EULA, for example to reflect changes in the App or the law. If we make important changes, we’ll tell you in the App or by email before they take effect. If you don’t agree, you can stop using the App and delete it.
Governing law
This EULA is governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
